Medical Records Price Index

The Ohio Revised Code 3701.741 establishes the allowable fees for providing copies of medical records in the State of Ohio. The original fees listed in ORC 3701.741 are subject to adjustment and shall be increased or decreased by the average percentage of increase or decrease in the consumer price index per ORC 3701.742. The Ohio Department of Health publishes the current medical record fees annually. 

Please note that in January 2016, the US Office for Civil Rights released guidance regarding the right of an individual to access their PHI under HIPAA, which included clarification on the appropriate fees for copies of medical records. This guidance conflicted with many state laws regarding the allowable fees and copy costs for medical records.  In response to concerns about this guidance, the Office for Civil Rights provided a new FAQ entitled New Clarification — Up to $6.50 Flat Rate Option regarding the amount of money an individual may be charged for a copy of their protected health information. Entities may choose the fee calculation method that is most appropriate for their circumstances, within the boundaries of what is permissible under the HIPAA Privacy Rule. 

 

2019 MEDICAL RECORD FEES*

*These fees are based on ORC 3701.742 and adjusted by ODH per ORC 3701.742 according to the annual consumer price index for all urban areas for the preceding year as published by the U.S. Department of Labor.


If the request is made by the patient or the patient's personal representative, total costs for copies and all services related to those copies shall not exceed the sum of the following:

With respect to data recorded on paper or electronically:
$3.25 per page for the first 10 pages,
$0.68 per page for pages 11-50
$0.27 per page for pages numbering more than 50

With respect to data resulting from an X-ray, MRI or CAT scan, recorded on paper or film:
$2.23 per page

The actual cost of any related postage incurred may be charged.


If the request is made other than by the patient or the patient's personal representative, total costs for copies and all services related to those copies shall not exceed the sum of the following: 

An initial fee of $20.06 to compensate for the records search

With respect to data recorded on paper or electronically:
$1.32 per page for the first 10 pages
$0.68 per page for pages 11 through 50
$0.27 per page for pages numbering more than 50

With respect to data resulting from an X-ray, MRI or CAT scan, recorded on paper or film:
$2.23 per page

The actual cost of any related postage incurred may be charged.
